Objectives of the Consultation and the Future Digital Fairness Act
The European Commission has launched this consultation to gather views on potential improvements to EU legislation, aiming to strengthen consumer protection and ensure a level playing field for traders. The initiative follows a “Digital Fairness Fitness Check” which identified problematic practices in the digital environment, including:
- Dark Patterns: Deceptive or manipulative interface designs that influence consumer decisions.
- Addictive Features: Digital product designs that encourage excessive and unintentional use.
- Unfair Personalisation Practices: The use of consumer vulnerabilities for commercial purposes.
- Misleading Influencer Marketing: Lack of transparency and the promotion of potentially harmful products.
- Difficulties in Managing Digital Contracts: Obstacles in cancelling or renewing subscriptions.
